General Terms and Conditions of Sale

Preamble

The main characteristics of the Products, including specifications, illustrations, and dimensions or capacity information, are presented in the Seller's catalogs. The photographs and graphics shown are not contractual and do not engage the responsibility of the Seller. The Customer is responsible for referring to the description of each Product to know its properties and essential characteristics.

Product offers are valid while stocks last.

In accordance with the introductory article of the Consumer Code: Any digital content is understood as: any tangible movable property that incorporates digital content or a digital service or that is interconnected with such content or service, in such a way that the absence of this digital content or digital service would prevent the good from fulfilling its functions.

The customer acknowledges having read and accepted these general terms and conditions of sale before placing their order. Therefore, validating the order implies acceptance of the general terms and conditions of sale.

Article 1 - Principles

These general terms and conditions express the entirety of the parties' obligations. In this sense, the customer is deemed to accept them without reservation. They apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution channels.

Article 2 - Content

The purpose of these general terms and conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by the seller to the buyer, from the website https://alienarts.co.

Article 3 - The order

The buyer has the possibility to place their order online, from the online catalog and by means of the form contained therein, for any product, within the limits of available stock.

The sale will be considered final after the seller sends the order confirmation to the buyer by email and after the seller has received full payment of the price.

Article 4 - Pre-contractual information

The buyer acknowledges having been made aware, prior to placing their order and concluding the contract, in a legible and comprehensible manner, of these general terms and conditions of sale and of all the information listed in Article L. 221-5 of the Consumer Code.

Article 5 - Electronic signature

The online provision of the buyer's credit card number and the final validation of the order shall constitute proof of the buyer's agreement to the payability of the sums due under the purchase order.

Article 6 - Order confirmation

The seller provides the buyer with an order confirmation by email once payment has been made.

Article 7 - Proof of transaction

The computerized records, kept in the seller's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Article 8 - Product information

The products governed by these general terms and conditions are those that appear on the seller's website and are indicated as sold by the seller. They are offered subject to availability.

Article 9 - Pricing conditions

The seller reserves the right to change its prices at any time, but undertakes to apply the prices in effect indicated at the time of the order.

Article 10 - Payment method

To pay for their order, the buyer has all the payment methods made available to them by the seller and listed on the seller's website, such as:

*Paypal
*Secure payment in several installments via Klarna

Article 11 - Product availability, refund, and resolution

Shipping times will be, within the limits of available stock, those indicated at the time of the order. In the event of non-compliance with the agreed date or deadline, the buyer must order the seller to execute within a reasonable additional period before terminating the contract.

Article 12 - Delivery methods

Delivery means the transfer to the consumer of physical possession or control of the good. The products ordered are delivered to the buyer by the seller's supplier according to the methods and the deadline specified above.

Article 13 - Delivery errors

The buyer must make any claim of delivery error and/or non-conformity of products to the seller no later than the first business day following delivery.

Article 14 - Product warranty

The seller guarantees the conformity of the sold good to the contract, allowing the buyer to make a request under the legal guarantee of conformity and hidden defects.

Article 15 - Right of withdrawal

The buyer has a period of 14 days from the date of delivery of their order to return any item that does not suit them and request an exchange or refund.

Article 25 - Protection of personal data

The personal data provided by the buyer is necessary for the processing of their order and the establishment of invoices.
